Woman's birth injury lawsuit wins $16 million

A woman who is pregnant often obssesses about what she wants her labor and birth to be like. Women often weigh the differences between a home birth, a hospital birth or a birthing center. Research usually helps the woman to make her decision. But, what happens if the facility the woman chose didn't live up to its advertised description? Does the mother have any recourse? The answer might just be that she can take action for the events that occurred.

One woman filed a lawsuit against the hospital where she gave birth, and her lawsuit was successful. She claimed that the hospital offered a personalized birth approach, and the hospital also noted that they provided women with the opportunity for a natural birth. The woman's experience was completely opposite.

The hospital that she chose for her fourth pregnancy offered birthing tubs, nice suites and promises to follow the woman's birth plan. That was a big change from the previous three deliveries in which she had to labor on her back and have medical interventions.

When the woman went into labor, she was horrified at what she experienced. She was physically forced onto her back by nurses. During the delivery, the nurses pushed on her son's head to keep him from delivering for six minutes until a doctor got there. That action gave her a severe birth injury known as pudendal neuralgia.

Ultimately, the woman's lawsuit netted $16 million for her physical injuries, pain and suffering. The jury in the case found that the hospital violated the standard of care for women who are in labor and delivering babies. It also found that the hospital misrepresented facts in a reckless manner.

Birth injuries of any sort might lead to claims for compensation. In those cases, working with someone familiar with the standard of care for labor and delivery is crucial since that can be a big element in the case.
